South Carolina Drunk Driver Detained In December Had Been Deported Three Times: Affidavit

Last week, a South Carolina grand jury indicted an illegal immigrant with a significant criminal record in the United States. The indictment came after the individual was arrested for driving under the influence in December and subsequently re-entered the country without authorization.

Sergio Ixtepan-Toto, a 36-year-old man, was taken into custody on December 6, 2024, in Pickens, South Carolina. He was arrested for driving under the influence when he narrowly avoided colliding with another vehicle on West Main Street in the town.

Ixtepan-Toto allegedly ran a stop sign and continued driving when a Pickens police officer tried to pull him over. He was eventually boxed into a store parking lot by the police officers.

During the stop, officers observed that Ixtepan-Toto did not pass a field sobriety test and had several open beer cans in his vehicle.

According to FOX Carolina, the incident report mentioned that he possessed a Mexican identification card.

On December 9th, Ixtepan-Toto was detained by Immigration and Customs Enforcement officers after being released on local charges.

According to a deportation officer’s affidavit filed on December 12, it was found that Ixtepan-Toto’s immigration file indicated that he had been deported in May 2020, November 2022, and February 2024.

“There is no record that Ixtepan ever obtained permission from the Attorney General of the United States or his successor, the Director of Homeland Security, to reapply to the INS or ICE for admission into the United States after having been arrested and deported,” the affidavit said.

According to information obtained by FOX Carolina, Ixtepan-Toto has a history of criminal charges in multiple jurisdictions within the state dating back to 2008.

He has a history of various charges, including speeding, driving without a license, domestic violence, indecent exposure, and four previous arrests for driving under the influence.
