Juan Alberto Rodezno-Marin had been arrested and deported from the United States in 2007, 2008, and 2009.
Last Wednesday, immigration officers in Massachusetts apprehended a Honduran individual. This person had previously been deported from the United States for illegally entering the country. The charges brought against him include sex crimes, assault and battery, as well as armed robbery.
According to a statement from U.S. Immigration and Customs Enforcement, Juan Alberto Rodezno-Marin, 39, is facing several charges, including indecent assault and battery on a person over 14, assault and battery with a dangerous weapon, masked armed robbery, and assault with intent to rape.
On January 22, ICE’s Enforcement and Removal Operations unit arrested him, and he is currently in custody.
“Mr. Rodezno will have his day in court, but he stands accused of some horrific crimes,” Patricia H. Hyde, acting field office director of ICE ERO Boston, said in the statement. “Not only did he repeatedly break U.S. immigration laws, but he apparently presents a substantial threat to the residents of Massachusetts.”
Rodezno-Marin had been arrested in 2007 for unlawfully entering the U.S. without inspection. He was subsequently extradited to Honduras on November 22, 2007, based on information from ICE. Following his initial arrest, Rodezno-Marin was arrested and deported twice more in 2008 and 2009 for illegally re-entering the country.
In December 2022, when Rodezno-Marin was detained in the Middlesex House of Correction, ICE ERO officers issued an immigration detainer. An immigration detainer is a request made by ICE to a law enforcement agency, asking them to notify ICE in advance before releasing an undocumented immigrant.
In a 2017 decision by the Supreme Judicial Court, it was ruled that law enforcement agencies cannot comply with these requests. According to Massachusetts law, court officers do not have the authority to arrest and detain individuals beyond their expected release time.
Rodezno-Marin faced arraignment in Middlesex Superior Court on March 9, 2023, on multiple charges including indecent assault and battery on a person over 14, assault and battery with a dangerous weapon, masked armed robbery, and assault to rape. Despite the detainer, the court decided to release Rodezno-Marin on December 4, 2024.
There was no update given on Wednesday morning regarding his ongoing case.
