President Donald Trump took action on Monday by signing an executive order that paves the way for the exclusion of transgender individuals from military service. This order revokes a policy implemented during the Biden administration that had allowed transgender service members. While no new ban was explicitly stated, it is anticipated that Trump will enact one in the near future as his administration actively targets transgender rights.
Once implemented, the ban is expected to lead to one of the most significant layoffs of transgender individuals ever witnessed. This action is also anticipated to face legal challenges, considering that the military is the largest employer in the country and transgender individuals are twice as likely to serve compared to their cisgender counterparts. Remarkably, this will be the second instance where President Trump has prohibited transgender individuals from serving in the military. The first ban was announced in 2017, resulting in an estimated 13,763 transgender individuals losing their jobs when it took effect in 2019.
President Joe Biden revoked Trump’s ban just days after assuming office in 2021. However, Trump retaliated on Monday by overturning Biden’s reversal and also targeting 78 other executive actions that were implemented during the previous administration. It is important to note that without the federal protections provided by Biden, the legal precedent set by the ban implemented during Trump’s first term still stands. In fact, the Supreme Court granted Trump the authority to enforce the ban in 2019, even though it had been blocked by four different courts prior to that decision.
The discussion surrounding transgender military service has been a topic of debate within the LGBTQ+ rights movement for over two decades. Until 2016, transgender individuals were prohibited from serving in the military, despite significant advancements in policies supporting queer Americans.
Trump claimed that transgender individuals adversely impacted military readiness and that providing gender-affirming healthcare would be a financial burden on the government. In response, the Palm Center, a former organization that examined LGBTQ+ military involvement, refuted these claims by stating that the costs associated with transgender healthcare were relatively insignificant, amounting to approximately $3 million per year.
According to Monica Helms, a Navy veteran and dedicated transgender activist, the exclusion of transgender individuals from the military would not only undermine national security but also subject them to potential mistreatment within the Department of Veterans Affairs.
According to Helms, the government incurs financial losses when it dismisses well-trained individuals. She emphasized that transgender individuals in the military are not limited to desk jobs; they serve in various roles such as aircraft carrier personnel, fighter pilots, and stationed positions in the Army and Marines. Helms also pointed out that transgender individuals are serving on submarines, much like she did back in the 1970s.
“It’s going to pose a real danger to our country,” she expressed concern.
According to Shannon Minter, legal director for the National Center for Lesbian Rights, a ban on transgender individuals serving in the military goes beyond the armed forces and poses significant dangers.
According to Minter, categorizing all transgender individuals as inherently unfit for military service would have significant repercussions for the federal government. Not only would it have a detrimental impact on the armed forces, but it would also extend to other aspects of life and employment. This kind of policy would essentially perpetuate the societal perception that transgender individuals are inferior and should be treated as such.
The exact number of transgender service members who will be impacted by Monday’s executive order remains unclear. According to the Williams Institute at the UCLA School of Law, there were an estimated 15,500 transgender service members in 2014. However, this data hasn’t been updated since then, partly due to the Palm Center closing in 2022 as a result of the progress made under President Biden’s administration, which allowed queer individuals to serve openly. Shannon Minter, a legal expert, believes that the ban will affect far fewer than 15,000 transgender individuals, with those who have undergone medical transition likely being the primary targets.
The responsibility of challenging the ban now rests on the shoulders of other national advocates, including Minter, who has confirmed that lawsuits are already being prepared.
“We have spent months preparing ourselves to confront any new prohibition,” he expressed. However, before proceeding with that, our intention is to persuade those who have a close association with the administration to reconsider, as numerous individuals are at risk of losing their livelihoods.”
According to the U.S. Transgender Survey (USTS), the unemployment rate for transgender Americans is currently five times higher than the national average in 2022, standing at 18 percent. It is worth noting that the military comprises approximately 2.1 million service members and nearly 800,000 civilian employees. Additionally, the 2015 USTS revealed that transgender individuals were twice as likely to serve in the armed forces compared to cisgender individuals.
Minter argues that the military’s focus on rewarding service rather than gender presentation is the primary reason behind this discrepancy.
“The military’s core value lies in the unity of individuals towards a shared mission or purpose, where differences become insignificant,” he expressed. “This overriding consideration is truly cherished by people.”
