Deaf man assaulted by Phoenix police seeks $3.5 million in damages

A deaf man, who was subjected to multiple punches and taserings by Phoenix police officers in August, has taken legal action by filing a $3.5 million notice of claim against the city.

Tyron McAlpin’s attorneys filed the claim on November 18, according to records.

According to attorney Jesse Showalter, officers Benjamin Harris and Kyle Sue allegedly engaged in a physical altercation with Tyron, involving beating and tasing. Showalter further claims that following the incident, Harris, Sue, and Officer Jorge Acosta fabricated charges against Tyron, leading to his unjust imprisonment for a period of 24 days.

On August 19, 2024, McAlpin found himself facing charges of resisting arrest and aggravated assault. The police had apprehended him based on allegations made by another man, which later turned out to be false and unverified.

After ABC15 aired footage of the arrest, which sparked national outrage, the Maricopa County Attorney’s Office decided to drop McAlpin’s charges the following week.

The Phoenix Police Department is currently conducting an internal investigation into the case. The arrest of McAlpin has resulted in the placement of two key officers on administrative leave.
